The Internal Revenue Service announced on June 14, 2021:  "Our offices have resumed many operations".

The I.R.S. will be resuming Notice of Federal Tax Lien (NFTL) and Levy programs.

In addition, the I.R.S. will be resuming other Collection Programs.

Once the I.R.S. has recorded a NFTL as a matter of public record, it directly impacts your standing in a Bankruptcy filing.

It is never to early to start thinking about filing your 2021 IRS and Arizona income taxes before April 15, 2022.

It is very unlikely that the IRS will extend the income tax filing deadline beyond April 15, 2022, as more and more Americans are vaccinated every day.

WASHINGTON — As part of a larger effort to ensure compliance and fairness, the Internal Revenue Service today announced that it will step up efforts to visit high-income taxpayers who in prior years have failed to timely file one or more of their tax returns.

Following the recent and ongoing hiring of additional enforcement personnel, IRS revenue officers across the country will increase face-to-face visits with high-income taxpayers who haven't filed tax returns in 2018 or previous years. These visits are primarily aimed at informing these taxpayers of their tax filing and paying obligations and bringing these taxpayers into compliance.

"The IRS is committed to fairness in the tax system, and we want to remind people across all income categories that they need to file their taxes," said Paul Mamo, Director of Collection Operations, Small Business/Self Employed Division. "These visits focusing on high-income taxpayers will be taking place across the country. We want to ensure taxpayers know their options to get right with their taxes and avoid bigger issues later."

For the current tax season, the IRS reminds taxpayers that everyone should file their 2019 tax return by the April 15 filing deadline regardless of whether they can pay in full. Six-month filing extensions are also available, although that does not extend the April deadline for paying any taxes owed.

"Taxpayers having delinquent filing or payment obligations should consult a competent tax advisor before waiting to be contacted by an IRS revenue officer, Mamo said. "It is always worthwhile to take advantage of various methods of getting back into filing or payment compliance before being personally contacted by the IRS."

For the new visits taking place, high-income non-filers taxpayers are those who generally received income in excess of $100,000 during a tax year and did not file a tax return with the IRS. Taxpayers who exercise their best efforts in filing their tax returns and paying or entering into agreements to pay their taxes deserve to know that the IRS is aggressively pursuing others who have failed to satisfy their filing and payment obligations.

During the visits, IRS revenue officers will share information and work with the taxpayer to hopefully resolve the tax issue.

On June 18, 2014 the IRS issued a press release, IR-2014-73, regarding modifications to the 2012 Offshore Voluntary Disclosure Program (OVDP). In addition to this press release the IRS on the same date issued a statement by IRS Commisioner John Koskinen.

Starting July 1, 2014, thousands (1,000's) of foreign financial institutions will begin to report to the IRS foreign accounts held by U.S. citizens.  This July 1, 2014 reporting requirement is part of the Foreign Account Tax Compliance Act (FATCA).

These modifications in particular reference U.S. taxpayers whose failure to disclose their offshore assets was non-willful.  For U.S. taxpayers residing in the United States, "the only penalty will be a miscellaneous offshore penalty equal to 5% of the foreign financial assets that gave rise to the tax compliance issue."

The IRS is almost doubling the penalty from 27.5% to 50%, for taxpayers not disclosing before  it becomes public that the taxpayer holds an account with an offshore financial institution!

The IRS is working with the U.S. Department of Justice to investigate foreign financial institutions that have assisted U.S. taxpayers in avoiding tax filing and paying obligations.

Quoting IRS Commissioner John Koskinen:  "We encourage taxpayers who are concerned about their undisclosed offshore accounts to come in voluntarily before learning that the U.S. is investigating the bank or banks where they hold accounts."  "For anyone who wants to come into compliance but isn't sure what to do, I recommend taking to a tax professional."

The IRS Commissioner John A. Koskinen on June 10, 2014 in the IRS Newswire announced the adoption of a "Taxpayer Bill of Rights". The Taxpayer Bill of Rights places existing rights currently in the Internal Revenue Code, and "groups them into 10 broad categories."

The IRS has posted the ten taxpayer rights on their website, IRS.gov.

In addition, the IRS has redesigned the Publication 1, to prominently feature these ten rights. The IRS Pub. 1 is included in millions of pieces of IRS correspondence each year.

The IRS Commissioner stated: "Respecting taxpayer rights continues to be a top priority for IRS employees, and the new Taxpayer Bill of Rights summarizes these important protections in a clearer, more understandable format than ever before". !

Three of the listed rights, "The right to challenge the IRS' position and be heard", "the right to Appeal an IRS decision in an independent forum", and "the right to retain representation" are particularly relevant to my representation as an Enrolled Agent.

 The IRS Commissioner also added: "Our establishment of the Taxpayer Bill of Rights is also a clear reminder that all of the IRS takes seriously our responsibility to treat taxpayers fairly".

The IRS has initially issued the redesigned Publication 1 in English and Spanish. The IRS in the near future will soon have updated versions of Publication 1 in Chinese, Korean, Russian, and Vietnamese. ! In summary, with this renewed emphasis on 'taxpayer rights' Enrolled Agent representation should benefit in dealing with IRS employees.
