The New York Times writer, Constance Gustke, on May 13, 2015, published the above titled article.
The article quotes several experts who explain the benefits to filing a Chapter 13 or Chapter 7 personal bankruptcy.
Under federal bankruptcy law(s) pensions, 401(k)', and IRA's can be exempeted from creditors. Social Security income is also exempt from creditors.
Howerver, the Bankruptcy Courts generally require that ALL unfiled Forms 1040 be filed, and continue to be filed, so that a Bankruptcy Discharge will be issued.
